1. Acceptance of Terms
By accessing or using SceneMuse.ai (“Service”) you agree to these Terms of Use. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization. Continued use after changes signifies acceptance.
2. Accounts & Credits
You must provide accurate information and safeguard credentials. You are solely responsible for all activity on your account. Credits are a prepaid license to consume rendering features, are non-transferable, non-refundable, and expire 24 months after issuance.
3. User Content & License
You retain ownership of assets you upload or generate. You grant SceneMuse.ai a worldwide, non-exclusive license to host, process, and transmit content solely to provide the Service. You warrant you have rights to all submitted materials and that they do not infringe others.
4. Prohibited Use
You may not misuse the Service, probe or breach security, distribute malware, infringe intellectual property, generate unlawful content, or reverse engineer components. We may suspend or terminate accounts violating these terms without refund.
5. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Output quality is not guaranteed and may change as models evolve.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENEMUSE.AI, ITS FOUNDERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. YOUR SOLE REMEDY IS TO STOP USING THE SERVICE. YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM ARISING FROM YOUR USE OR CONTENT.
7. Payment & Taxes
You authorize us or our processors to charge your payment method for credits, subscriptions, or usage fees. Prices may change with notice. You are responsible for all applicable taxes, duties, or governmental assessments.
8. Termination
You may terminate at any time by deleting your account. We may suspend or terminate access immediately for any violation, suspected abuse, or to comply with law. Upon termination, licenses granted to us end, but sections concerning ownership, indemnity, disclaimers, and limitations survive.
9. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to jurisdiction there.
